The Nottingham Express Transit System Order

GENERAL GUIDANCE NOTE ON TRANSPORT AND WORKS ACT (TWA) ORDERS

Note:  This guidance is not a formal application document and is provided for general information only.

1). Transport and Works Act Orders are a special form of statutory authority which a public body or a private developer can apply for in order to build a railway, tramway or other forms of development such as some port and harbour works, bridges and tunnels.  The Order, if approved, authorises the construction of the works proposed and may also provide additional powers, including compulsory purchase powers.  Transport and Works Act Orders also allow planning permission to be obtained at the same time as the Order from the Secretary of State (rather than by way of a planning application to the local council).

2). Applications for these Orders are made to a Secretary of State (i.e. to central government) but are subject to local advertisement, notice and inspection requirements.  This is intended to ensure that everyone who is affected is informed or can find out about the proposals and can inspect copies of the application documents.  You can therefore find out more about an application from the details in these advertisements and notices and by looking at the application documents.

3). Applications have usually also been the subject of extensive prior consultation and some of those likely to be affected will receive not less than 28 days’ formal notice of an application.   

4). The application documents will include, amongst other documents, a draft of the proposed Transport and Works Act Order, an explanation of its contents, various plans, an application to the Secretary of State for planning permission (if that is being sought) and usually an environmental statement. The environmental statement will often provide the clearest and most detailed description of the proposals and includes a concise summary which provides, in simplified form, a snapshot of the proposals. 

5). Objections and other representations can be made to applications but must be made to the Secretary of State before the end of the specified period.  They must also be in writing, stating the grounds of objection or representation, indicate who is making the objection or representation and give a contact address.  The specified period for objections or representations will not be less than (and is usually exactly) six weeks from the date of the application.

6). All such objections and representations which are properly made, other than any which are frivolous or trivial or which relate to matters of compensation, will be taken into account by the Secretary of State before determining the application.  Disputes concerning compensation are referred to and decided by the Lands Tribunal.

7). Shortly after the end of the objection period, if significant objections have been lodged (e.g. an objection by someone subject to compulsory purchase), the Secretary of State usually appoints an independent inspector to hold a public local inquiry into the proposals.  The inquiry will normally begin about five months after the end of the objection period and may last one or more days or a period of weeks depending upon how many people and how much evidence needs to be heard. In this case The Nottinghamshire County Council and Nottingham City Council expect that there will be a public inquiry in November 2007.

8). The procedure where a public local inquiry is called is very similar to that for major planning appeals.  First, the parties are asked to lodge statements of case (i.e. a written summary of what they want to put to the inquiry), usually within a period of six weeks.  Then, a little later, a pre-inquiry meeting will often be held by the Inspector to discuss administrative arrangements.  Proofs of evidence are then exchanged in advance of the inquiry and, at the inquiry, witnesses are examined on their evidence with oral submissions also being made.  The applicants and some other parties may be represented by one or more barristers or other professionals at the inquiry but any person who is entitled to appear may do so on their own or through a representative of their choice.  Following the inquiry, the Inspector reports to the Secretary of State and, sometime later, the Secretary of State will decide whether to allow the application and whether any modifications to it may be required.  The Secretary of State’s decision is given in writing and will be accompanied by the publication of the Inspector’s report. It will also be advertised and those who appeared at the inquiry will be sent a copy.

9).  INFORMATION ON PUBLIC INSPECTION AND SALE OF THE NOTTINGHAM EXPRESS TRANSIT SYSTEM TWA APPLICATION DOCUMENTS

10). Nottingham City Council and The Nottinghamshire County Council have applied to the Secretary of State for Transport under section 6 of the Transport and Works Act 1992 for an Order to authorise the construction and operation of two extensions to the existing Nottingham Express Transit system (known as NET Line One) running between Nottingham City Centre and Hucknall – from the City Centre to Clifton via Wilford, and from the City Centre to Chilwell via the Queen’s Medical Centre and Beeston.

11). A copy of the application, and of all plans and other documents submitted with it, may be inspected free of charge from Thursday, 26 April 2007 until Thursday, 7 June 2007 by visiting the following locations:—

The locations above will be open at the times listed, except on Monday, 7 May 2007 and Monday, 28 May 2007 when they will all be closed.  Nottingham City Council offices will also be closed on Tuesday, 29 May 2007.
